TERMS AND CONDITIONS

 

APPLICATION PROCESS

  • All stallholders wishing to participate must complete a Stall Holder Application Form.

  • If offered a stall, payment will be debited from your card 15 days prior to the market. If payment is not received by this time, the spot will be offered to another applicant.

  • Submission of an application does not guarantee a stall. If successful, you will receive an offer email and must confirm your participation with payment.

  • Proof of insurance and Street Trader registration must be provided no later than 14 days before the event. Failure to do so will result in forfeiting your spot with no refund.

STALLS

  • Table/space dimensions:

    • Indoor Single Site: 2.4m x 2m 

    • Indoor Double Site: 4m x 2m 

STALLHOLDER RESPONSIBILITIES

  • Stallholders must ensure their stall is maintained in the same condition as upon arrival. Any cleaning or repair costs due to negligence will be charged to the stallholder.

  • Site maps may be adjusted on the day of the event, so flexibility is appreciated.

  • All products sold must be related to baby and kids

CANCELLATION POLICY

  1. Cancellation by Stallholder

    • Stallholders wishing to cancel their participation must notify the event organizers at least 24 hours before the scheduled market start time.

  2. Cancellation Within 24 Hours

    • If a stallholder cancels within 24 hours of the market’s scheduled start time, a $30 cancellation fee will apply. This fee is non-refundable and will be charged to the stallholder’s account.

  3. No Show Policy

    • If a stallholder fails to attend the market without prior notice or valid explanation, it will be considered a no-show, and a $30 cancellation fee will be imposed. Two no-shows may result in the stallholder being prohibited from participating in future markets or events organized by the event organizers.

  4. Cancellation Fee Payment

    • The cancellation fee must be paid promptly. Failure to settle the fee may result in the stallholder being prohibited from participating in future markets or events organized by the event organizers.

  5. Refunds and Credits

    • The $30 cancellation fee is non-refundable under any circumstances, including if the cancellation is due to an emergency or unforeseen event.

    • Stallholders who cancel within the 24-hour window can not receive a refund for any site fees paid but may use their paid fees as credit for a future market if applicable.

  6. Failure to Cancel or Notify

    • If a stallholder fails to notify the event organizers of their cancellation in accordance with this policy or fails to appear without notifying the organizers, the event organizers may refuse to invite them to participate in future events.

  7. Exceptional Circumstances

    • In certain circumstances (e.g., emergency or illness), stallholders may request special consideration for cancellation fees. Requests must be submitted in writing and are at the sole discretion of the event organizers.

  8. Acknowledgement

    • By applying to participate as a stallholder, you acknowledge and agree to the cancellation fee policy outlined above and understand that any cancellation made within the specified time frame will result in the associated cancellation fee.

Stallholder Cancellation Policy

It is the sole responsibility of the stallholder to cancel their application directly through ISSIMO MARKETS using the official cancellation process provided. Cancellations made via any other method (including, but not limited to, social media messages, emails, texts, or phone calls) will not be accepted or honoured.

If payment is processed and the stallholder has not submitted a cancellation through ISSIMO MARKETS directly, no refund will be issued under any circumstances.

By submitting an application, the stallholder acknowledges and agrees to this cancellation policy in full.

EARLY DEPARTURE POLICY 

By participating in this market/event, all vendors agree to remain set up and open for business for the full duration of the event as specified by the organizers.
Early Departure Fee: Any vendor who chooses to leave the market prior to the official end time, without prior written approval from event organizers, will be subject to a $30 early departure fee. This fee will be invoiced and must be paid within 7 days. Failure to comply may affect eligibility for future events​
 

All stallholders are expected to remain set up and trading for the entire advertised duration of the market.

Stallholder Commitment to Market Hours

All stallholders are required to remain fully set up and trading for the entire advertised duration of the market. Early departure or pack-down is not permitted unless prior written approval has been granted by market management.

Leaving early negatively affects the market in several key ways:

1. Market Reputation & Appearance

An incomplete or half-empty market gives the impression of poor organization or low attendance, which reflects badly on everyone involved. A vibrant and fully-operating market encourages visitors to stay longer, spend more, and return in the future — benefiting all stallholders.

2. Customer Expectations & Trust

The market is advertised to the public as operating until a specific time. When customers arrive and see stalls missing or packing up, it creates disappointment and damages the credibility of the market. Patrons may not return if they feel misled or that their time isn’t valued.

3. Occupational Health & Safety (OHS) Concerns

Packing up while patrons are still present creates serious safety hazards. Trolleys, vehicles, sharp objects, and heavy equipment pose risks in crowded areas. Accidents during pack-down could lead to injury, liability claims, or even the loss of venue approval.

4. Disruption to Other Stallholders

Early departures disrupt neighboring stalls, create traffic bottlenecks, and break the customer flow. Stallholders who stay until the end may lose potential sales due to an uninviting atmosphere created by others packing up early.

5. Loss of Sales Opportunity

Some of the best sales happen in the final hour when customers make final decisions or return to purchase. Leaving early means missing out on potential revenue, especially from those who arrive late due to work, family, or travel.

6. Contractual Obligation

By applying to trade, stallholders agree to the market's terms, including full attendance. Leaving early may result in warnings, cancellation of future bookings, or being excluded from future markets. We value commitment and consistency.

7. Impact on Future Growth & Funding

A consistently full market helps secure partnerships, sponsorships, council approvals, and promotional support. Gaps and empty stalls during advertised hours can jeopardize the market's ability to grow and receive ongoing backing.

In Summary

Remaining for the full market duration is part of your commitment as a stallholder. It ensures safety, professionalism, and a high-quality experience for all involved. We appreciate your support in keeping the market strong, safe, and successful.

STALL FEES

  • If fees remain unpaid 7 days before the market, your stall will be withdrawn.

  • If you arrive after 8:30 am on market day, you will not be permitted to trade and will not receive a refund.

  • Payment will be debited automatically, and no reminders will be sent.

Non-Transferable Site Fees 

  • All site fees paid to participate in our events are strictly non-transferable to other stallholders under any circumstances.

  • Stallholder Responsibility
    The booking and associated fee are allocated solely to the individual or business whose name appears on the original application. It cannot be sold, gifted, or reassigned to another person, business, or entity.

  • No Subletting or Substitution
    Stallholders are not permitted to sublet, share, or substitute their site with another stallholder or business without prior written approval from the event organisers.

  • Changes & Cancellations
    If a stallholder is unable to attend, the site fee will not be credited, refunded, or transferred to another party. Any request for credit or rollover must be made by the original applicant and is subject to our cancellation policy.

  • Enforcement
    Failure to comply with this condition may result in immediate cancellation of your booking without refund, and may affect your eligibility for future events

REFUND POLICY

In the event that the market is cancelled by the organiser for any reason (including but not limited to extreme weather, venue issues, or unforeseen circumstances), stall holders will be entitled to one of the following options:

  1. 50% Refund – Stall holders may request a refund of 50% of the total site fee paid.

  2. Fee Transfer – Alternatively, stall holders may choose to transfer 100% of their site fee to a future market organised by us, subject to availability and confirmation.

Please note: The 50% refund reflects costs already incurred by the organiser prior to the event, including venue hire, marketing, logistics, and administrative expenses. These costs are non-recoverable even if the market is cancelled, and the partial refund ensures fairness while helping sustain future events.

Stall holders must notify the organiser of their preferred option within 7 days of receiving the cancellation notice.

Failure to notify the organiser within this 7-day period will result in forfeiture of the site fee, and no refund or transfer will be offered.
 

1. All Sales Are Final

Once payment is made and your stall is confirmed, no refunds will be issued under any circumstances, including but not limited to:

  • Change of mind

  • Scheduling conflicts

  • Weather conditions

  • Low sales or foot traffic

  • Personal emergencies

2. Stall Transfers

If you are unable to attend, you may transfer your stall to another approved vendor with written permission from the event organizer at least before the event. Transfers without prior approval will not be permitted.

3. Event Cancellation or Postponement

  • If the event is cancelled by the organizers, stall fees may be refunded or credited toward a future event, at the discretion of the organizers.

  • If the event is postponed, all bookings will be transferred to the new date. No refunds will be issued.

4. Non-Compliance and Forfeiture

Stall holders who fail to comply with event rules or fail to show up on the day of the event will forfeit their booking and any associated fees. No refunds will be provided in such cases.

By booking a stall, you agree to this No Refund Policy in full. We appreciate your understanding and support in helping us run a smooth and successful event for all participants.

Terms and Conditions for Equipment Hire – Market Day

1. Booking and Payment

  • All equipment must be booked and paid for in advance. We will not accept any equipment hire requests on the day of the market.

  • Bookings are confirmed only once full payment has been received.

  • Equipment availability is limited and offered on a first-come, first-served basis.

2. Collection and Return

  • Stallholders must sign in and sign out their hired equipment with a member of the organising team.

  • Equipment will be available for collection during designated setup times.

  • All hired items must be returned in the condition they were provided by the end of the market day.

3. Responsibility During Hire

  • Stallholders are responsible for all equipment from the time of collection to the time of return.

  • Equipment must be used responsibly and only for its intended purpose.

  • Stallholders must ensure equipment is not left unattended or exposed to theft or damage.

4. Loss or Damage

  • Any equipment that is lost, stolen, or damaged while in the stallholder’s care will incur a replacement or repair fee, charged to the stallholder.

  • Fees are based on the full replacement value or cost of repair, as assessed by the organisers.

5. General Conditions

  • Equipment must not be altered or modified.

  • The organisers reserve the right to refuse hire to any stallholder who does not comply with these terms.

  • The organisers accept no liability for any personal injury or property damage arising from misuse or improper handling of the equipment.

6. Acknowledgment

  • By booking and paying for equipment hire, stallholders acknowledge that they have read, understood, and agreed to these terms and conditions.

Responsibility for Property

  1. Stallholders are solely responsible for all items, equipment, and belongings brought to the market.

  2. The market organizers do not accept any responsibility or liability for items that are lost, stolen, or left behind after the market has concluded.

  3. It is the responsibility of each stallholder to ensure that all of their property is removed from the site at the end of the event.

  4. Any items left on-site may be disposed of at the discretion of the market organizers, and the stallholder may be charged for any associated removal or disposal costs.

  5. Stallholders are encouraged to double-check their stall area before departure and to ensure that no personal or business items are left behind.

 

 

By submitting your application through the ISSIMO Market platform and completing a payment, you agree to the following terms and conditions regarding payments, fees, and refunds.

1. Payment and Billing

When you submit your application to become a stallholder through the ISSIMO Market platform, the site fee will not be automatically deducted at the time of submission. Payment will only be taken automatically once your application has been approved by the event organizers. Upon approval, the required site fee will be automatically deducted from your payment method by ISSIMO Market, the official booking platform for this event.

2. No Refund Policy

Once the payment for the site fee has been processed and funds have been successfully deducted by ISSIMO Market, no refunds will be issued under any circumstances. We do not offer refunds, exchanges, or credits for any transactions once payment has been made.

 

3. Automatic Deduction of Site Fee

By submitting your stallholder application through the ISSIMO Market platform, you acknowledge and agree that the site fee will be automatically deducted only after your application has been reviewed and approved by the event organizers. Once approved, you consent to the automatic deduction of the site fee by ISSIMO Market from your payment method, and you understand that this payment is non-refundable.

4. Exceptions

In some specific circumstances, and at our sole discretion, we may consider providing a refund or adjusting the site fee. These exceptions may include, but are not limited to:

  • Duplicate payments made by mistake

  • Technical issues preventing the completion of the transaction or access to services

Any request for an exception must be made in writing to our customer support team within [insert number of days] days of the transaction.

5. Disputes and Chargebacks

If you initiate a chargeback or dispute a transaction after payment has been processed by ISSIMO Market, we reserve the right to suspend your application or restrict your access to the event until the matter is resolved. Any chargebacks may also result in a permanent ban from participating as a stallholder in future events.

6. Agreement

By submitting your application through the ISSIMO Market platform and agreeing to these Terms and Conditions, you acknowledge that you have read and understood the no refund policy and automatic deduction of the site fee by ISSIMO Market once your application is approved. You also agree to be bound by these terms and conditions. If you do not agree with this policy, please refrain from submitting your application.

7. Changes to Terms

We reserve the right to update, modify, or change these Terms and Conditions at any time. Any changes will be posted on this page, and the effective date will be updated accordingly.

LICENCES AND PERMITS

  • Stallholders must ensure compliance with all relevant product, safety, business, and trade legislation.

  • Food vendors must provide a current copy of insurance, permits, and food certificates when applying.

  • Failure to submit Street Trader/Food Trader permits 14 days prior to the market will result in forfeiture of your stall.

LOSS AND DAMAGE CLAIMS

  • Market coordinators are not liable for any damages or injuries related to your products, stall equipment, or actions at the event.

  • By participating, you agree to indemnify market coordinators and the venue against any claims.

PHOTOGRAPHS AND PROMOTIONAL MATERIAL

The market organizers may take photographs, videos, or other media during the event for promotional and marketing purposes. By participating in the market, you grant permission for your stall and products to be included in such media.

Compliance with Local Laws

  • Stallholders are required to comply with all applicable local laws, regulations, and ordinances while participating in the market.

  • Stallholders must ensure that all items for sale are in compliance with the relevant consumer protection laws.

Kids Activities Disclaimer – “That’s Mine” Events

  • By attending our market and allowing your child to participate in any of the kids’ activities provided, you acknowledge and agree to the following:

  • Participation is at your own risk. “That’s Mine” Events, its staff, volunteers, stallholders, and associated partners accept no liability for any injury, accident, loss, or damage that may occur as a result of participation in children’s activities or while on the event premises.

  • Parental/guardian supervision is required at all times. Children must not be left unattended. Parents and guardians are solely responsible for the care, conduct, and supervision of their child(ren) throughout the event.

  • Activities are designed to be safe and age-appropriate, however, not all activities may be suitable for all children. It is the responsibility of the parent/guardian to determine whether an activity is appropriate for their child’s age, ability, and physical condition.

  • Health & medical considerations: If your child has any medical conditions, allergies, or special needs, please inform activity facilitators where applicable and take any necessary precautions. “That’s Mine” Events cannot be held responsible for any health-related incidents.

  • Hygiene and sanitation: While we aim to maintain a clean environment, shared materials (e.g. craft tools, face paints, petting animals, play equipment) may carry risks. Parents/guardians are advised to supervise hygiene practices before and after participation.

  • Photography and media: By entering the market, you consent to the possibility of photos or videos being taken for promotional purposes. If you do not wish your child to be photographed, please inform our staff or photographers on the day.

  • Behavioural expectations: “That’s Mine” Events reserves the right to remove or refuse access to any activity to any individual whose behaviour is deemed unsafe, disruptive, or inappropriate.

  • Weather-related risks: Activities may be impacted by weather conditions. Wet, hot, or windy weather can pose additional hazards, and it is the responsibility of the parent/guardian to ensure their child is dressed appropriately and remains safe.

  • By attending the event and allowing your child to participate, you waive any right to claim against “That’s Mine” Events or any of its affiliates for injury, loss, or damage arising from participation in the market or any associated activities.

  • We thank you for your cooperation in helping us create a safe, fun, and family-friendly environment.

To maintain a safe, enjoyable, and family-friendly environment for all attendees, vendors, and participants, That's Mine Events markets strictly prohibit the sale of the following items:

1. Alcohol

Alcohol is prohibited unless specifically authorized by event organizers, who will ensure that all necessary permits and regulations are in place. Selling alcohol without proper authorization is not allowed and could result in immediate removal from the market.

2. Drugs or Controlled Substances

The sale of illegal drugs, narcotics, or prescription drugs without proper prescriptions is strictly prohibited. This includes substances that are illegal to possess or distribute according to local laws. This also includes drug paraphernalia.

3. Weapons or Firearms

The sale of weapons, including firearms, knives, tasers, pepper spray, and any other weaponry, is strictly prohibited. This ensures a safe environment for all market attendees, especially families and children.

4. Tobacco and Vaping Products

Smoking and vaping products are not permitted for sale at our markets. This includes cigarettes, cigars, e-cigarettes, vape pens, and any related accessories. Smoking-related products can create safety hazards and may negatively impact the atmosphere of the event.

5. Pornographic or Explicit Materials

The sale of adult material, including explicit books, magazines, videos, or other media, is not allowed. We strive to maintain a family-friendly atmosphere where all visitors, including children, can feel comfortable and safe.

6. Counterfeit or Fake Goods

 Selling counterfeit or fake products is strictly prohibited. This includes items that are replicas of popular branded products or goods that infringe on trademarks, patents, or intellectual property rights. These items not only violate the law but also mislead consumers.

7. Stolen or Illegally Sourced Products

Description: The sale of stolen or illegally sourced products is prohibited. All vendors must have proof of legal ownership or authorization to sell the items in their booth. Selling such items is illegal and could lead to serious consequences.

8. Hazardous Materials

Any hazardous materials, such as flammable substances, chemicals, toxic items, or other dangerous goods, are not permitted for sale. This includes products that could pose a risk to health, safety, or the environment.

9. Live Animals or Insects

 The sale of live animals or insects is prohibited unless specifically authorized by event organizers. This includes pets, exotic animals, and insects. In some cases, specific permits may be required for such sales, but they are generally not allowed to ensure safety and animal welfare.

10. Food or Drink Items

the sale of food or drink is only allowed for vendors who have been pre-approved and hold the necessary permits and licenses. Unauthorized food sales are prohibited to ensure that food safety regulations are adhered to and that appropriate health standards are met.

11. Items that Violate Copyright or Trademark Laws

Items that infringe on copyright or trademark laws are strictly prohibited. This includes unlicensed reproductions of branded merchandise, unauthorized copies of music, movies, books, or artwork. Such sales can result in legal action from the intellectual property owners.​

12. Items with Offensive or Discriminatory Content

The sale of items that contain hate speech, racial slurs, or discriminatory messages is prohibited. This includes any materials that promote violence, racism, sexism, or any form of discrimination. We strive to create a respectful and welcoming environment for all.

13. Fireworks or Explosives

The sale of fireworks, firecrackers, or any other explosive materials is prohibited. These items are hazardous and pose a significant safety risk in a public setting. Selling them without the appropriate safety measures is not allowed.

14. Unapproved Promotional Materials

Description: Selling or distributing promotional materials unrelated to the market, such as flyers, pamphlets, or advertisements for non-market businesses or events, is prohibited unless specifically approved by event organizers. This ensures that all promotional efforts are relevant and respectful to the market's atmosphere.​

15. Health and Beauty Products

The sale of unregulated health or beauty products, including items that are expired or do not meet required safety or health standards, is prohibited. This includes products like cosmetics, skincare items, and supplements that have not been approved by relevant health authorities or do not meet labeling regulations.

16. Used or Second-Hand Items

The sale of used or second-hand items is generally prohibited unless explicitly allowed by the event organizers. Some markets, like vintage or charity sales, may allow second-hand items, but these will be subject to specific guidelines and must meet safety and quality standards.

17. Items that are Non-Compliant with Local Health and Safety Regulations

Any items that do not meet local health, safety, or legal standards are prohibited. This includes products that do not adhere to regulatory requirements set by local authorities, such as unsafe toys, unapproved electrical goods, or products that violate food safety standards.​

This list is designed to maintain the integrity of our markets and ensure a positive, safe, and family-friendly experience for all. That's Mine Events reserves the right to remove any vendor found selling prohibited items, and violations of these rules may result in being banned from participating in future events.

Wet Weather, High Winds, and Extreme Heat Policy

1. Event Cancellation Due to Adverse Weather

  • The safety and well-being of our stallholders, visitors, and staff are our top priority. In the event of extreme weather conditions, including heavy rain, high winds, or extreme heat (temperatures reaching 38°C or higher), the event organizers will assess the situation and may decide to postpone or cancel the market.

  • Cancellation or Postponement Decision:

    • The decision to cancel or postpone the market will be made by the event coordinators, who will closely monitor weather reports and conditions.

    • The decision will be communicated as soon as possible, typically no later than 4 hours before the event starts. If adverse weather develops during the event, the market may be canceled or closed early for safety reasons.

2. Types of Adverse Weather Conditions

  • Heavy Rain: If rain becomes torrential or if there is significant risk of flooding, the event may be canceled or postponed.

  • High Winds: If wind speeds reach over 40km/h, stallholders with outdoor setups may be required to pack down early, as high winds can cause damage to equipment, marquees, and display items.

  • Extreme Heat: If temperatures reach 35°C or higher, the market may be canceled or rescheduled for the safety of participants and attendees.

3. Communication of Cancellation or Postponement

  • Stallholders will be notified via email, phone, or text message as soon as the decision is made to cancel or postpone the event. It is essential that stallholders keep their contact details up to date during the application process.

  • Notifications will also be posted on the event’s official website and social media channels for public awareness.

4. Refund or Roll-over Options

  • If the market is canceled due to weather conditions (rain, high winds, or extreme heat), stallholders will have the option to:

    • Receive a full refund, or

    • Roll over their stall fee to the next scheduled market (subject to availability).

  • No Refund for Partial Cancellations: If the market proceeds with a modified schedule or if only a portion of the event is canceled, refunds will not be issued.

5. Stallholders' Responsibility During Adverse Weather

  • Stallholders are responsible for ensuring their stalls are safely set up and prepared for adverse weather, including:

    • Heavy rain: Bringing waterproof coverings, tarps, or suitable shelter for their goods.

    • High winds: Ensuring that equipment and marquees are securely weighted (minimum 20kg per leg) and properly anchored.

    • Extreme heat: Taking measures to protect products from damage (e.g., bringing shade and cooling equipment).

  • Marquee Guidelines: If using a marquee, it is essential to secure it properly to avoid damage or injury during high winds. If the winds become unsafe, stallholders may be asked to pack down early.

6. Weather-Related Early Departure

  • If conditions become unsafe due to heavy rain, high winds, or extreme heat during the event, stallholders may be required to pack down early.

  • In case of early departure, no refunds will be issued for any stall fees, and stallholders will not be compensated for lost trading time.

7. Event Rescheduling

  • If the market is rescheduled due to adverse weather conditions, stallholders will be required to confirm their availability for the new date. If a stallholder cannot attend the rescheduled event, they will be offered a credit for a future event, rather than a refund.

8. Extreme Weather Preparedness

  • In case of high winds or heavy rain, stallholders should bring:

    • Secure weights for marquees and tents (minimum 20kg per leg).

    • Waterproof covers or tarps for their products.

    • A first aid kit for safety in case of accidents caused by wind or rain.

  • In the case of extreme heat (over 38°C), stallholders are encouraged to:

    • Bring plenty of water, shade, and cooling equipment.

    • Ensure products are kept in cool conditions and avoid damage from heat.

    • Use sunscreen and wear hats for sun protection.

By participating in ‘That’s Mine’ Events, stallholders acknowledge the possibility of adverse weather cancellations or adjustments and agree to the conditions outlined in this policy. Our goal is to ensure a safe and enjoyable market experience for all, even in challenging weather conditions.

 

Kids Activities Disclaimer – ALL FOR KIDS MARKETS

By attending our market and allowing your child to participate in any of the kids’ activities provided, you acknowledge and agree to the following:

  • By attending the event and allowing your child to participate, you waive any right to claim against “That’s Mine” Events or any of its affiliates for injury, loss, or damage arising from participation in the market or any associated activities.

STALLHOLDER CODE OF CONDUCT

  1. Social Media Policy: Positive promotion of the event is encouraged. Negative commentary on social media will result in exclusion from future events.

  2. Stall Placement: Management determines stall placements and may adjust layouts if necessary.

  3. Operational Requests: Stallholders must cooperate with reasonable safety and quality requests from management.

  4. Product Standards: Only approved products may be sold. New products must be pre-approved by management.

  5. Courtesy and Respect: Treat fellow stallholders, staff, and visitors with professionalism and respect.

  6. Conflict Resolution: Resolve issues directly with event organisers without escalating them publicly.

  7. Unacceptable Behaviour: Verbal or physical abuse is strictly prohibited and will result in immediate removal from the market.

By participating in ‘That’s Mine’ Events and ALL FOR KIDS MARKETS, stallholders agree to abide by these terms and maintain a positive, professional environment for all attendees.
